Introduction and Acceptance

Welcome to Fizzy Fox, operated by PLAYTHOPIA ENTERTAINMENT LLP. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "You," or "Your") and PLAYTHOPIA ENTERTAINMENT LLP ("Company," "We," "Us," or "Our") governing your use of our game zone facilities, website, and services.

By entering our premises, making a booking, using our website (fizzyfox.in), or availing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services or enter our premises.

This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable and amended provisions pertaining to electronic records in various statutes.

Eligibility and Age Restrictions

General Entry: All visitors must comply with age and height restrictions for specific activities as displayed at our facility.

Children Under 3 Years: Entry for infants and toddlers under 3 years requires mandatory supervision by a parent or legal guardian who must remain with the child at all times.

Children 3-7 Years: Children in this age group must be supervised by a responsible adult. One guardian is permitted complimentary entry for supervision purposes.

Children 7-18 Years: Children aged 7 and above may participate in activities independently, subject to height, weight, and skill requirements for specific games. However, a responsible adult must be present on the premises.

Adults 18+ Years: Adults may use all facilities subject to activity-specific restrictions.

Special Requirements: Certain high-intensity or physically demanding activities may have additional age, height, weight, or health restrictions that will be clearly displayed and enforced for safety reasons.

Booking and Reservations

Advance Booking: We recommend advance booking, especially during weekends, holidays, and peak hours. Bookings can be made through our website, mobile app, phone, or in person.

Walk-ins: Subject to availability, we accept walk-in customers. However, priority is given to customers with confirmed bookings.

Booking Confirmation: You will receive a booking confirmation via WhatsApp and/or email containing your booking details, timing, and a unique booking reference number.

Accuracy of Information: You are responsible for providing accurate information during booking. Any errors may result in cancellation or inability to honor the reservation.

Modification of Bookings: Bookings can be modified subject to availability by contacting us at least 24 hours in advance. Last-minute changes may not be accommodated

Time Slots: Each session is subject to specified time limits. Extensions may be available at additional cost, subject to availability.

Payment Terms

Payment Methods: We accept payment through credit cards, debit cards, UPI, net banking, mobile wallets, and cash. All online payments are processed through secure, PCI-DSS compliant payment gateways.

Pricing: All prices displayed on our website and premises are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.

Advance Payment: For bookings and party packages, we may require advance payment or deposit. The balance must be paid before or on the day of the event.

Payment Gateway Fees: We do not charge additional fees for using specific payment methods. However, your bank or payment provider may levy charges.

No Hidden Charges: All charges will be clearly communicated before payment. We do not add hidden fees.

Game Credits and Prepaid Cards: Prepaid game cards can be purchased for use within our facility. These cards are non-transferable and subject to our refund policy.

Receipt: A receipt will be provided for all transactions, either physically or electronically.

Cancellation and Refund Policy

Please refer to our detailed Refund Policy below. In summary :

• Cancellations 48+ hours in advance: Full refund minus processing fee
• Cancellations 24-48 hours in advance: 50% refund
• Cancellations less than 24 hours: No refund, but may reschedule subject to availability
• No-shows: No refund
• Our cancellations: Full refund or complimentary rescheduling

Safety Rules and Code of Conduct

Your safety is our priority. All visitors must comply with the following

Mandatory Requirements:

• Wear appropriate footwear and clothing suitable for physical activity
• Grip socks are mandatory for trampoline and certain play areas (available for purchase)
• Remove sharp objects, jewelry, hair clips, and accessories that may cause injury
• Follow all safety instructions provided by staff members
• Use equipment only as instructed

• Running in non-designated areas
• Rough play, fighting, or aggressive behavior
• Use of mobile phones or cameras on rides/activities unless permitted
• Bringing outside food, beverages (except sealed water bottles with prior permission), weapons, illegal substances, or hazardous materials
• Misbehavior with staff or other customers
• Vandalism or misuse of equipment

Health and Fitness:

• Visitors with medical conditions (heart problems, pregnancy, back/neck issues, epilepsy, etc.) must consult their physician before participating
• Inform staff of any medical conditions before participation
• We reserve the right to deny access to activities if we believe participation poses safety risks

Supervision: Children must be supervised according to age requirements. Parents/guardians are responsible for their children's safety and behavior.

Staff Instructions: All visitors must follow instructions from Fizzy Fox staff members at all times. Non-compliance may result in immediate removal from the activity or premises without refund.

Violation of Rules: We reserve the right to refuse entry, remove visitors, or terminate services without refund for violations of safety rules, code of conduct, or Terms and Conditions.

Liability Waiver and Release

BY ENTERING OUR PREMISES AND PARTICIPATING IN ACTIVITIES, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

Assumption of Risk: You acknowledge that participation in gaming and recreational activities involves inherent risks including but not limited to minor injuries (bruises, cuts, sprains), serious injuries (fractures, dislocations), illness, emotional distress, property damage, or in extreme cases, death. You voluntarily assume all such risks.

Release of Liability: To the fullest extent permitted by law, you hereby release, discharge, and hold harmless PLAYTHOPIA ENTERTAINMENT LLP, its directors, officers, employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you or your property while participating in activities at Fizzy Fox, whether caused by negligence, equipment failure, or otherwise.

Parental Consent for Minors: If you are a parent or legal guardian bringing a minor child, you represent that you have authority to bind the minor to these Terms. You acknowledge and accept all risks on behalf of the minor and waive all claims against Fizzy Fox related to the minor's participation.

Medical Fitness: You represent that you and any minors under your supervision are in good physical and mental health and have no medical conditions that would prevent safe participation. You assume responsibility for any injuries resulting from undisclosed medical conditions.

Property Damage: We are not responsible for loss, theft, or damage to personal belongings. Secure storage lockers are available for rent.

No Liability for Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control including natural disasters, government actions, pandemics, or other force majeure events.

Limitation of Liability: To the maximum extent permitted by law, our total liability for any claims arising from your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Legal Limitations: Some jurisdictions do not allow limitation of liability for certain types of damages. Where such limitations are not permitted, our liability will be limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence.

Insurance: We maintain general liability insurance and take reasonable precautions for visitor safety. However, we strongly recommend that visitors maintain their own personal accident and health insurance

Intellectual Property Rights

Ownership: All content on our website, marketing materials, and premises including trademarks, logos, text, graphics, images, videos, software, and game-related content is owned by or licensed to PLAYTHOPIA ENTERTAINMENT LLP and is protected by Indian and international intellectual property laws.

Trademarks: "Fizzy Fox," our logo, and related marks are trademarks of PLAYTHOPIA ENTERTAINMENT LLP. Unauthorized use is prohibited.

Copyright: All original content, including website design, promotional materials, and proprietary games, is protected by copyright.

License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only.

Prohibited Uses: You may not copy, modify, distribute, sell, lease, reproduce, reverse engineer, or create derivative works from any content or materials from our premises or website without prior written permission.

Third-Party IP: Some games and content at our facility may be licensed from third parties. All third-party intellectual property rights are respected and protected.

User-Generated Content: Any feedback, suggestions, or content you provide to us may be used by us without compensation or attribution.

Photography and Media Consent

Venue's Right to Photograph: By entering Fizzy Fox premises, you grant us the irrevocable, royalty-free right to photograph, video record, and capture your image and the image of any minors accompanying you for promotional, marketing, security, and operational purposes.

Use of Images: We may use photographs and videos captured at our facility in advertising, social media, website, print materials, and other promotional activities without compensation to you.

Security Surveillance: Our premises are equipped with CCTV cameras for security and safety purposes. Footage may be used for security management, incident investigation, and may be provided to law enforcement if required.

Customer Photography: Personal photography for non-commercial use is generally permitted in designated areas. However, photography is prohibited on certain activities for safety reasons.

No Commercial Photography: Commercial photography, videography, or filming requires prior written permission and may be subject to fees.

Opt-Out: If you do not wish to be photographed for promotional purposes, please inform our staff at the time of your visit. However, security camera footage cannot be opted out of.

Protection of Others: When taking personal photographs, respect the privacy of other visitors and obtain their consent if they are prominently featured.

Prohibited Activities and Restrictions

The following activities are strictly prohibited at Fizzy Fox:

• Illegal activities of any kind including possession of illegal substances, weapons, or contraband
• Harassment, bullying, discrimination, or abusive behavior toward staff or other customers
• Creating disturbances that interfere with others' enjoyment
• Bringing outside food or beverages (except as permitted)
• Smoking, vaping, or consumption of alcohol (unless in designated areas with permission)
• Gambling, betting, or games of chance for money
• Unauthorized commercial activities or solicitation
• Tampering with equipment, electrical systems, or safety devices
• Attempting to access restricted areas
• Any activity that violates applicable laws or these Terms

Force Majeure

We shall not be liable for any failure or delay in performance of our obligations due to circumstances beyond our reasonable control, including but not limited to :

• Acts of God (earthquakes, floods, storms, pandemics)
• Government actions, laws, or restrictions
• Civil unrest, riots, or terrorism
• Fire, power failure, or infrastructure breakdown
• Labor disputes or strikes
• Equipment failure despite reasonable maintenance

In such events, we will make reasonable efforts to resume services promptly. You may be entitled to rescheduling or refunds as appropriate.

Dispute Resolution and Grievance Redressal

Internal Grievance Mechanism: We are committed to resolving customer complaints promptly. If you have any grievance:

• We will investigate and respond within 7 working days
• If unresolved, you may escalate to our management

Consumer Forums: Under the Consumer Protection Act, 2019, if your complaint is not resolved satisfactorily, you may file a complaint with:

• District Consumer Disputes Redressal Commission (DCDRC) for claims up to ₹50 lakh
• State Consumer Disputes Redressal Commission (SCDRC) for claims ₹50 lakh to ₹2 crore
• National Consumer Disputes Redressal Commission (NCDRC) for claims above ₹2 crore

National Consumer Helpline: You may also register complaints with the National Consumer Helpline at 1915 or through their website consumerhelpline.gov.in.

Mediation: We encourage mediation and alternative dispute resolution before litigation.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Nasik, Maharashtra.

Amendments

We reserve the right to modify, amend, or update these Terms at any time. Material changes will be posted on our website with the "Last Updated" date. Continued use of our services after modifications constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement
